Hello sir , I have signed one offer letter 4 weeks...

Hello sir , I have signed one offer letter 4 weeks before but after signing my visa got expired and had fine 10 riyal per day . I have already told company regarding this but they told they will process my visa with two weeks and only two weeks have to pay ..but still now they didnot process visa and I have got offer letter from another company and I wanted to leave the present company but they holds my passport and they asked me to do a task and have finished and they told me in mail my documents are ready to give . But they are playing with me I think so . They are holding my passport and NOC ..they didnot processed my visa to their company . I need a solution for this . Please and thanks in advance

We would like to inform you that your inquiry is based on two legal points:

First: Your employer's holding of your passport

The law regulating the entry and exit of foreigners affirms the need for the employer to hand over the passport and the Labor card after the completion of the work permit procedures and he is not entitled to retain these documents. If he failed to do so, the employer is punished with a fine not exceeding 25,000 riyals and therefore we advise you to file a complaint against the employer at the Labor Office to take the necessary action against him.

Second: Overstay and fines imposed

  This overstay is the employer's fault, so you shall file a complaint at the Labor Office, then you shall go to the Immigration and Passport Department and submit a complaint with a copy of the complaint filed against the employer.

Following are the relevant law texts for your inquiry:

Article 8:

 Any Expatriate who is resident in the State of Qatar shall obtain a permit from the appropriate competent authority. The sponsor shall comply with the formalities for the required residence permit and the renewal thereof, provided that the application for renewal is made within a period that shall not exceed ninety days from the date of the expiry of the said permit. The sponsor shall deliver to the sponsored person his passport or travel document after finalizing the residence formalities or after applying for the renewal thereof.

 Article 39:

Without prejudice to any more severe penalty provided in another law:

1- Any person who contravenes the provisions of Article (8 / Third Paragraph) of this Law shall be punished by a fine not exceeding (25,000) twenty five thousand riyals.

2. Any person who contravenes the provisions of Article (19) of this Law shall be punished by a fine not exceeding (50,000) fifty thousand riyals.
