Article (41)
The worker may leave the work before the end of the contract and retain all his rights after notification to the employer in any of the following cases:
- If the employer or his representative has been subjected to fraud at the time of contracting in respect of the terms of employment.
- If the employer does not comply with the worker's basic obligations in accordance with the provisions of this law and the contract of employment.
- If the employer or his representative commits an insult to morality towards the worker or a member of his family.
- If he is attacked by the employer or his representative.
- If there is a serious risk to the safety or health of the worker provided that the employer has been aware of the existence of this risk and did not implement the measures prescribed by the competent authorities on the date set for them.
Article (42)
Subject to the provisions of the Social Security Law, if the employee leaves the job for one of the reasons mentioned in the previous article, the employer is obliged to pay him for the period of his service, without prejudice to the worker's right to compensation which may be determined.
