I just want to ask if i can file case for the father of my kids here in Dubai his living with one lady and we come to visit him but he didnt find place for my kids to stay and we are living on bedspace while him and the lady on a luxury flat

It should be noted that after reviewing your inquiry and legal scrutiny we would like to inform you that according to the UAE Penal Code, what your husband exposed is a crime which called "Condoning or encouraging sin", so you can go to the Public Prosecution and file a criminal case against him
Article (312)
Detention and a fine, or one of these two penalties shall be imposed upon any one who commits any of the following crimes:
1. Abuse of any sacred or holy Islamic rites.
2. Blaspheming any of the divine recognized religions.
3. Condoning or encouraging sin, publicizing it, or acting in a manner that tempts others to commit such sins.
4. Knowingly eating pork by Muslims.
You can also file a case for divorce for the harm that is happening to you by going to the guidance and family support and according to the provisions of article (16) personal status and before resorting to the court.
Therefore, the case must first be registered by any party in the family guidance section in one of the emirates of the state.
Where the parties coordinate and schedule a meeting with the family counselor..
- Interviewing the family counselor is mandatory for divorce proceedings in the UAE. Couples are allowed to express their concerns about marriage in the absence of their legal representative.
- Friendly divorce can be reached at this stage. The parties shall formulate and sign a settlement based on mutual understanding between the parties before the family directive
- If one or both of the parties insists on a divorce, the family counselor submits a referral letter to the application to allow them to appear before the court to conclude the divorce case.
- The letter may be submitted to the Court at any time within three months from the date of issue
