It should be noted that after reviewing your inquiry and legal scrutiny we would like to inform you that the law aims at increasing the guarantees of movement freedom and the travel freedom abroad as one of the aspects and elements of personal freedom enshrined in the Constitution by imposing the necessary provisions regarding the issuance of travel bans.
The decree provides that the plaintiff may obtain an order from the court to prevent the defendant from traveling if the following conditions are met:
-If there are serious reasons to believe that the defendant's escape from the dispute is imminent.
-if the claim is based on a dent, or that the existence of the right of the appearance of the leaves is likely.
The applicant or the person who issued the travel ban must declare that the order has been issued if he is released in his absence, within eight days from the date of issue with a written letter of arrival.
The court may issue the travel ban as a matter of urgency without summoning the other party. If the order is rejected, the court may issue the right to appeal to the court that issued it within eight days from the date of its issuance.
This date shall not apply to the person
who issued the order in absentia except from the date of its
declaration.
The court may support the order, amend it or cancel it, and the defendant may object to the order whenever the circumstances justify it within eight days from the date of his knowledge of these circumstances. The issuance of the travel ban order shall not prejudice the implementation of the deportation order issued against the respondent or the authority of the administration.
Termination of the foreigner's residence
or his order to leave the country in accordance with the provisions of the law.
According to the new decree, the prohibition of travel will expire in any of the following cases: If the plaintiff or the person issuing the order does not declare the person who issued the travel ban pursuant to the provisions of the second paragraph of Article 178 of this law, The conditions necessary for the order to prevent travel, if the defendant is presented as an admissible court agent or a cash guarantee that the court appreciates to ensure the execution of what may be judged in the proceedings,
If a period of sixty days has passed since the judgment has been issued and it becomes final in the claim for debt, the travel ban
is issued for his application, without the creditor having
submitted it to the Execution Court requesting the execution of the judgment.
If the creditor person does not pay the debt, and the judge finds that he is able to fulfill the order and does not comply, or if the convicted person is a foreigner and is afraid of fleeing the country in order to evade execution, the convicted person may request that he be prevented from traveling unless the convicted person submits a request for court approval with regard to the settlement of debt settlement or the request for installment with or without the sponsor, and the ban on travel in this case expires at the end of one year from the date of issue, unless it is proved that the convicted person has concealed his money which can be seized or smuggled abroad, if he has not offered an acceptable settlement or has not offered an acceptable instrument or has offered a settlement and breached its terms.
If it is proven to the execution judge at any time that the convicted person has no money to be executed and has not smuggled it abroad, he must lift the ban on travel. The issuance of the travel ban order shall not prejudice the implementation of the deportation order issued against the defendant or the authority of the administration to terminate the foreigner's residence
or order him to leave the country in accordance with the provisions of the law.
