About visa Cancellation , Labour Fine & visa...
About visa Cancellation , Labour Fine & visa fine
My sister has a case in court & police took her passports & kept it
Then , her Visa is already finished in April 24, 2019 . Her company try to renew her visa without Passport but unfortunately she can’t get it
& Her company renew only her Labor Card for next 3 years
So , she doesn’t have valid visa anymore but she has labour card
Then, Her company said without Visa , she can’t work anymore & forced her to resign. Finally she resign from her company
The Case is still going on in Court & she’s still facing
My question is
1: she has to pay Fine for overstaying without visa ??
( We Check in police station & police said no need to pay fine bcoz her passport is kept in courts. After finishing case , she need to clarify from which date to which date her passport was kept & she need to write clearance letter that they Said .
Is it true she need to pay fine or not??)
2:need to pay fine also for her labour Renewal to her company??
Company said she need to pay fine for daily for her labor during she stay in Dubai

It should be noted that after reviewing your inquiry and legal scrutiny we would like to inform you according to the Emirati Residence Law and the executive regulations, about the police is not correct about the exemption from paying the fine, since the jurisdiction in this matter is for emigration and residence of foreign affairs.
But with holding the passport, you cannot settle the residence as well as leave the state, which result break the visa, so an application shall make in the court and replace the passport with another if the court approved for the purpose of renewal.
But
as long as the case is not over, it is possible to apply to the court for exemption or you have to pay it
*** As for the other part of the question and with holding the passport, you can object about your claiming to pay any amount by the employer as compensation, you can go to the Labor Office and file a complaint and explain the matter in detail so that the employer does not ban you from working in the state and force you to leave with generalization
