Assalamu Alaykum, Mr. Hassan, My brother works in Saudi Arabia as a procurement supervisor since February 2024, since past 3 months, he had two eye surgeries where he suffering with lot of pain and there is no relief for his surgeries when he asked the company for a sick, leave to go back to his Home city, But the company is refusing to the sick leave, and he doesn’t have a proper work timings so that he can take care of himself and his eyes.He stays in a Camp which is far away from City, if he want to visit a medical Centre, he can’t take a taxi or a cab. if he has to visit city, then he must go in the companies car, otherwise, there is no option to go to City for his medical purpose. So please kindly suggest me what to do for the further process. He wants to come back to India. He’s not feeling well there, so please suggest me how can we proceed for further instructions and stuff, thank you.

There is no legal text that obliges the employer to agree to the worker's travel to his country during sick leave.
If the employer refuses to agree to grant the worker sick leave, the worker can file a complaint with the Labor Office against the employer.
Here is the text of the Saudi Labor Law, related to your inquiry:
Article Twenty-Nine:
If any worker sustains a work injury that results in a deficiency in his usual abilities that does not prevent him from performing a job other than his previous job, the employer for whom the worker's injury occurred due to his work must employ him in the appropriate job at the specified wage for that job. This does not prejudice the compensation he is entitled to for his injury.
Article 117: The worker who proves his illness has the right to sick leave with pay for the first thirty days, and with three-quarters of the pay for the following sixty days, and without pay for the thirty days that follow during one year, whether these leaves are continuous or intermittent. One year means: the year that begins from the date of the first sick leave.
