I’ve had a rental case in which first cheque didn’t go through due to an unknown issue, however, there was no issue as I’ve been informed that I can transfer the money directly to an owner. Shortly, I’ve had a major issue in the apartment as there was a rapid growing mold as the apartment was flooded prior my move in and agent hid it from me instead, which caused major mold breakage. I’ve been told that the maintanance will take up to 2 months, but I’ve been assured that they ll relocate me elsewhere for the maintanance duration. I’ve been given an option to move out without paying for anything and promised that I will be released from paying the first cheque. Fast forward, I moved out after 1,5 month, have been promised that my security deposit will be transferred on previously agreed date and ejari contract will be canceled as well. A month has passed with no reply from the agency either owner, after which agency has sent me an email to provide them with my bank account so they can deposit the remaining amount from the first cheque and security deposit. It seemed like they have forgotten that the first cheque didn’t go through, therefore, I’ve emailed them back that the only amount which they have to transfer back to me is my security deposit as the first cheque hasn’t gone through due to an error. A week later, I’ve received a bank transfer in which they’ve transferred to me the remaining amount of first cheque ( which has never been paid) and the deposit, even tho I’ve told them the only the despot should be transferred back to me. I’m wondering what’s the law in the UAE when it comes to that? As in my home country, if someone have transferred to you a wrong (either higher amount or you got a transfer by mistake) you are entitled to keep the money and not return it, it’s up to our kindness whether we will be willing to return the money or not. I’ve read online that if someone transfers to me money by mistake I’m obligated to return, however, in my case, they’ve transferred intentionally, to the correct beneficiary. Is it illegal for me to keep it or it’s up to me to decide what to do with it at the end? Thank you for your help.
