The Omani legislator has preserved the rights of workers in the private sector by obtaining an end-of-service gratuity after the end of the contractual relationship with the employer, provided that such service is not less than a year, and that gratuity is calculated based on the number of years the worker spent working with the employer.
If we assume that the worker continued to work for the employer for a period of five years, then he is entitled to an end-of-service gratuity for the first three years with a salary of (15) fifteen days for a full basic salary for the fourth and fifth years; That is, an average of two salaries and fifteen days, from the basic salary agreed upon in the contract.
And that bonus that the worker gets after the end of the work period with the employer is like an encouragement to stay with the employer for a period and a longer period, in order to settle the workers in the companies and with one employer, and in order to encourage production and exert full care in the company to obtain the desired returns And so that the worker can be reassured that his work and effort throughout his work with the company will not be in vain, and that the company will reward him for his efforts during the work period.
Article (39) of the Omani Labor Law stipulates, (The employer must, with regard to workers who do not benefit from the provisions of the Social Insurance Law, if the work relationship ends, pay the worker a reward for his period of service, equivalent to fifteen days’ wages for each year of service for the first three years, And a month’s wages for each of the following years, and the worker is entitled to the reward for fractions of the year in proportion to the period he spent in service, and the last basic wage of the worker is taken as the basis for calculating the reward).
