I found this contact number from a website. I have an issue regarding my cancellation of visa delayed by my employer. Below are the details. I am facing life issues due to delays in my visa cancellation. I received a notice of Termination on 30th of January 2023 due to my performance. My employer terminated me directly in a meeting and send a notice in written format. As per the notice I have to do a handover of my work and company assets during my notice period of 30 days. My notice period ended on 1st of March 2023 and I submitted my handover on 24th Feb 2023 by email to employer. After that I took my annual leaves as I had a lot of annual leaves pending. On 6th of Feb 2023 I requested my cancellation then company asked me to check my email where employee asked me that email handover is not a satisfactory handover they need more explanation. I explained more in email to employer. They said they need a meeting. We schedule an online meeting on 20th of March 2023 as per employer availability. In that meeting he requested another meeting on later date and asked me to prepare a context of deliverables document. I submitted that document on 26th of March 2023 as it took me sometime to do this job for him. They schedule another meeting on 3rd of April 2023. That was again delay. He attended meeting with 15 minutes delay and finish 5 minutes earlier and told me that he will prepare another list of questions for me. I have to write the answers of those questions and then he will do another follow up meeting with me. Until today 7th of April I am asking them these questions and follow up meeting but they are not giving me any answer. I am also requesting them to atleast give me cancellation of my visa. I will do all the answers whenever employer ready but company is not canceling my visa. I am very disturbed mentally and in a fear that what if my employer do file a case or do other actions to make it more delay. He is a wealthy person and I am a normal worker. I wanted to solve the matter with company employer on good notes but now I reach to a limit because I am not on a payroll of the company anymore from 1st of March 2023 and it’s April now. I have no income. To start my life again I need this cancellation. I am looking an assistance how can I get this cancellation fast without hassle as I am not in a position mentally to fight with someone. Your feedback and response will be greatly appreciated. Regarding your inquiry about the company not canceling the visa despite the termination of your work, please note that in this case you can submit a complaint to the labor office to help you in the termination and help you get your dues
Indeed. As long as you end your contract legally, you have the right to get your End of Service Benefits, as it is calculated upon your last paid salary.
UAE Labor Law stipulates the following:
Article 26
A worker who has completed one or more years of continuous service shall be entitled to severance pay at the end of his employment. The days of absence from work without pay shall not be included in calculating the period of service. The severance pay shall be calculated as follows:
1. 14 days' wage for each of the first five years of service.
2. A worker shall be entitled to severance pay for any fraction of a year he actually served, provided that he has completed one year of continuous service.
