1. The lessor shall have the request to evict the lessee from the property before the expiry of the lease period exclusively in any of the following cases:
(A) If the Tenant fails to pay the rent or any part thereof within thirty days from the date of notifying the lessor of payment, unless otherwise agreed by the parties.
B- If the tenant rents the sub-property or any part of it without obtaining the written consent of the lessor, in which case the eviction will apply to the lessee and the sub-tenant while preserving the right of the latter to refer to the lessee for compensation.
(C) If the tenant has used the property or allowed others to use it for an unlawful purpose or in violation of public order or public morals.
(D) If the leased property is a commercial property, and the tenant leaves it without occupancy for a period of 30 consecutive days or ninety consecutive days per year unless the parties agree otherwise.
(E) If the tenant changes the property so as to affect his safety in such a manner that it is not possible to return it to its original state or to cause damage to the property as a result of its deliberate act or gross negligence to take care or to allow others to inflict such damage.
F) If the Tenant uses the property other than the leased purpose for it or uses it in contravention of the planning, construction and land use regulations in force in the Emirate.
(G) If the property is a fall, provided that the lessor proves it with a technical report issued by or approved by Dubai Municipality.
H- If the Tenant fails to comply with any obligation imposed by this Law or any of the terms of the lease, within thirty days from the date on which the lessor is notified of the execution of that obligation or condition.
I- If the requirements of development and urban development in the Emirate necessitate the demolition and reconstruction of the real estate, as determined by the competent governmental authorities.
For the purpose of item (1) of this Article, the lessor shall be notified to the lessee through the notary public or registered mail.
2. The lessor shall have the request to vacate the lessee from the property at the end of the lease contract exclusively in any of the following cases:
A-If the property owner wishes to demolish it for reconstruction or wishes to add any new buildings that prevent the tenant from using the leased property, subject to obtaining the necessary licenses from the competent authorities.
B- If the condition of the property requires restoration or comprehensive maintenance. It is impossible to carry out the repair and maintenance work with the tenant in the property. The condition of the property shall be verified by a technical report issued by or approved by Dubai Municipality.
(C) If the owner of the property wishes to recover it for his personal use or for the use of any of his relatives up to the first degree, provided that he proves that he does not own the appropriate alternative for that purpose.
D) If the landlord wishes to sell the leased property.
In the four mentioned cases, the landlord shall notify the tenant of the reasons for evacuating the property at least 90 days before the expiry of the contract term.
