We would like to inform you that according to the UAE Penal Code, obtaining a photograph or photograph without permission is punishable by a law that verifies the rules of crime, which is the physical ground and the moral ground. Therefore, if the image is obtained and published or used in social media sites, it is considered a crime to hit the general staff. The Federal Penal Code shall be punishable by imprisonment for a period not exceeding one year and a fine not exceeding 10.000 AED or by one of the penalties, for anyone publish photos or comments or news related whether public or private even it was true, as this considered threat to an essential part of the society values and traditions.
For photographing in public places, the law does not criminalize video or photography of persons in public places, and the victim has the right to file a civil case to compensate for the material or moral damage suffered by him, if he proved that.
Article 10 of the Federal Criminal Procedures Law stipulates that a criminal case may not be filed for the following crimes except upon a written or verbal complaint from the victim or his legal representative: -
1- Theft, fraud, breach of trust and concealment of the things obtained from them if the victim was the spouse of the perpetrator or one of his ascendants or descendants and these things were not subject to judicial or administrative seizure or burdened with the right of another person.
2- Failure to hand over the child to whoever has the right to seek his request and take it away from the authority of whoever takes over or sponsors him.
3- Refraining from paying alimony, foster care, nursing, or accommodation.
4- Insulting and slandering people.
5- Other crimes stipulated by law.
The complaint shall not be accepted after three months from the day the victim and the perpetrator became aware of the crime, unless the law provides otherwise.
