I have registered a case against my partner ( who is also the managing director of the company) he transferred amount to his personal account on daily basis The niyaba transferred the case to criminal court with the remark " embezzlement of money violating the right of rightful party" Now he hired a lawyer and says I will prove the company going into losses and I'll take the lawyer fee and audit fee and company loss from you once he proves all this in court Is that possible??

That case shall then be closed up with proving the validity of the complaint you filed against your partner and thereof you convicted him of the former charges.
This is to avoid that your partner could file a case against you on charges false defamation and smearing, which is a crime punishable by imprisonment and a fine, or at least one of the two penalties.
Your partner may also, if he gets exonerated and your complaint was proved false, so your partner in this case may claim compensation for the damages caused to him due to false accusations.

He says it was for Petty cash However funds have also been transferred to his girlfriend account and he says my visa was expired, however in my statement I told the public prosecution if he's guilty of these charges , he is most welcome to prove company in loss Beside that he haven't given any profit to me since 5 years ( since company started)And he was keeping a car financed under my name and wasn't paying installments and refusing to give the car back .
