How can I help with your legal question?Hi I am a German national living in UAE my mother has passed away and has left a will and has put me as the only beneficiary I have no other siblings no father only grandparents, but recently I have converted to Islam just to marry muslim girl Where are you located? We would like to inform you that if it is a will and it was less than one third, you may take it but if it is an inheritance, it is not permissible for you to take it, and you may take it and distribute it to poor people, and if you are poor, you may take as much as you need.

Why is it not permissible!? I have become Muslim, why do I have to loose my right!? She was still my mother!? Only if I do crim or murder I should be disinherited? She was my biological mother and I have no one anymore my father passed away when I was 3 and now I lost my mother I have no siblings

Why the inheritance should be taken from me and go to my non muslim grandparents ? This is my right as her only son and why would the law take this from me and give it to my non muslim family?

If they disinherit me my wife and I will have no house as the house we live in was under my mothers name!? How is this fair? I haven’t done anything wrong

She was my mother my biological and legal mother we live together and we were all we had to each other my mother respected me for becoming Muslim and had no problem ? Otherwise; she would change her will. This would be the last thing she would want to happen! She wanted everything to me the law in my country would give everything to me why the Islamic law should take it away from me and give to non muslim relatives!?

Does sharia law really wants me and my wife on the street!? As according to sharia law I got 0. I don’t understand why I am being punished I haven’t done anything wrong!? Shouldn’t they be supportive and understanding? My country as a non Muslim country is giving 100% to the child which is me and my grandparents according to that law get nothing but now In this case sharia law is favoring non muslims who live in non muslim country and completely against. I don’t know what to do

We would like to inform you that you aren’t allowed to inherit from your mother due to the difference of religion which prevents inheritance, and you may take from the inheritance what you need as the house in which you live

The scholars are in agreement that a non-Muslim cannot inherit from a Muslim and vice versa according to the Islamic law of inheritance

This is based on the hadith narrated by Imam Bukhari in which the Prophet (Peace and Blessings of Allah be upon him) said: The believer does not inherit from a disbeliever and the disbeliever does not inherit from a believer

However, a Muslim can leave a bequest in favor of a non-Muslim family member/friend provided the bequest does not exceed 1/3 of the total estate

If your deceased mother (peace on her) has left a bequest in our favor you should take the 1/3 of the total heritage

The same ruling applies to someone who joined Islam after the death of his inheritor
