We would like to inform you that if you wish to terminate the contract during the probation period, as once the foreign worker wishes to terminate the contract during the probation period to leave the country, he shall notify the employer of that in writing fourteen days before resignation. And if either party terminates the employment contract without taking this into account , the worker is obliged to pay compensation to the employer equal to the worker’s wages for the period of notice. But if there is no probation period in the employment contract, you shall formally notify the employer of your desire to terminate the contract and commit to work within the notice period agreed upon in the contract, provided that the period shall not be less than 30  days and not more than 90 days, and if the worker fails to comply with this, he shall be obligated to compensate the employer, and the compensation shall be equal to the wage of the worker for the entire notice period or the remaining part thereof.

This is in accordance with the provisions of the Labor Law as follows:

Article 9:

4-If the foreign worker wishes to terminate the work contract, during the probation period, to leave the country, he shall notify the employer of this in writing at least fourteen days before the date specified for the termination of the contract.

5- If either party terminates the employment contract without taking this article into account , the worker is obliged to pay compensation to the employer equal to the worker’s wages for the period of notice.

Article 43:

either party in the employment contract can terminate the contract for any 'legitimate reason', provided that: a written notification is given to the other party and. the terminating party serves a notice of 1 month (30 days) to 3 months (90 days).

The employment contract continues for the duration of the notice period referred to in this article, and ends with the expiry of the period.

  The worker shall be paid in full for that period according to the last wage he was receiving, and he shall perform the work during that if the employer asks him to do so. It is permissible to agree on exemption from the notice period condition or reducing its period while preserving all the rights of the worker for the notice period agreed upon in the employment contract.  It is stipulated that the notice period shall be for one time for both parties, unless it is for the benefit of the worker.

  • The party who did not abide by the notice period must pay to the other party a compensation called a notice period allowance, even if the failure to warn did not result in harm to the other party, and the compensation shall be equal to the worker's wage for the entire warning period or the remaining part thereof.
